DATA PRIVACY COMPLAINTS PROCEDURE

This Data Privacy Complaints Procedure is available for any data subject whose personal data is processed by House of Nature Safaris. Please refer to the sections below to find the information relevant to your request or complaint.

1. Employees

1.1 As an employee of House of Nature Safaris, if you have a complaint about the way in which your personal information has been handled or if you would like to request access to copies of your HR file or other personal information or exercise any of your other rights, please contact an HR representative from your local office. If you are not satisfied with the response of the HR representative, you may proceed with the complaints procedure for Other Inquiries, as described below.

1.2 If you do not feel comfortable in making your complaint to your local HR department, you may direct your query to the local Office Administrator or HNS’s Data Privacy Office.

2. Former Employees

2.1 As a former employee of House of Nature Safaris, if you would like to request access to copies of your personal information, such as your HR file or exercise any of your other rights, please contact an HR representative from your local office. Absent exceptional circumstances, we will acknowledge your request within 48 business hours and will provide a substantive response as soon as practicable, in accordance with any time limits set down by law. Where permitted by law, we may charge a fee for the provision of copies of your personal information.

2.2 If you are not satisfied with our response, you may proceed with the complaints procedure for Other Inquiries, as described below.

3. Marketing Requests

If you would like to request marketing materials from House of Nature Safaris, you may subscribe at the following web address: https://houseofnaturesafaris.com/ . If you would like to update your contact information for House of Nature Safaris marketing materials, or if you would like to be removed from any e-mail or other distribution lists for House of Nature Safaris marketing materials, you may do so at the same link or you can send an email to unsubscribe@houseofnaturesafaris.com. Absent exceptional circumstances, we will remove your email address from the relevant distribution list(s) within 48 business hours. If you are not satisfied with our response, you may proceed with the complaints procedure for Other Inquiries, as described below.

4. Other Inquiries

4.1 If you have a complaint about the way in which your personal information has been handled or would like to access or correct your personal information or exercise any of your other rights, please contact the Office of the Data Protection Commissioner (ODPC). The Office of the Data Protection Commissioner Monitors compliance with the firm’s Privacy Standards and is the initial contact point for any enquiry or complaint relating to compliance with those Standards. The ODPC will undertake an independent review of the investigation into your complaint and advise you of the conclusions. 4.2 You may request a full copy of the House Of Nature Safaris Data Privacy Standards by contacting info@houseofnature safaris.com.

4.3 You may submit your request or complaint via email to info@houseofnature safaris.com, which is the email address of the House Of Nature Safaris (HONS). Please mark your email with “Privacy Enquiry” in the subject line and in the email provide:

  1. Your full name;
  2. Your address;
  3. The full details of your data privacy request or complaint;
  4. Any previous correspondence with us regarding the specific data privacy issue; and
  5. If you have incurred a loss, evidence to show the value of the loss.

4.4 You may be asked to provide proof of your identity.

4.5 Upon receipt of a request or complaint, House Of Nature Safaris will:

  1. Confirm receipt, where possible, within 2 working days;
  2. Assess the request or investigate the complaint fully; and
  3. Provide further information regarding the status of your complaint within 2 weeks of receipt of your written request or complaint except that, if the investigation or assessment cannot be completed within 2 weeks, we will write to you to tell you when we expect to respond.

Requests to exercise rights under EU Privacy Laws will be dealt with within one month of receipt of a valid request, unless the request is complex, in which case the period may be extended by up to two further months. We will inform you if any extension of time is required in such cases.

4.6 If you are still not satisfied with our actions and findings, or at any other time if you so choose, you may:

  1. contact and/or lodge a complaint with the Chair of the House Of Nature Safaris Data Privacy Committee by email at dpo@houseofnaturesafaris.com
  2. Contact and/or lodge a complaint with the Office of the Data Protection Commissioner (ODPC), O Box 30920-00100 G.P.O Nairobi. Further information and contact details can be found at https://www.odpc.go.ke/report-a-data-breach/
  3. Bring a claim in the relevant courts as specified under Data Protection Act, 2019.
